1. Acceptance of Terms

By accessing, browsing, donating to, registering for events, or participating in any fundraising activity, sweepstakes, or promotion operated by Sacred Mothers Sanctuary Homes (“SMSH,” “we,” “our,” or “us”), you agree to be bound by these Legal Terms & Conditions, our Official Sweepstakes Rules, and any applicable Winner Agreement.

If you do not agree to these terms, you may not participate in SMSH programs, sweepstakes, or fundraising activities.

2. Organizational Purpose

Sacred Mothers Sanctuary Homes is an Oregon-based organization formed to support survivors of abuse and human trafficking through the development of trauma-informed sanctuary housing and healing services.

All activities, including fundraising and sweepstakes promotions, are conducted in furtherance of this charitable mission.

3. Donations & Use of Funds Disclaimer

All donations made to SMSH are voluntary.

Funds raised through donations, events, or sweepstakes-related fundraising activities may be used, at the discretion of SMSH and in furtherance of its mission, for purposes including but not limited to:

  • Preparing and submitting grant and loan applications
  • Employee compensation and staffing costs during the planning and build phase
  • Advertising, marketing, and public awareness
  • Legal, organizational, and administrative expenses, including articles of incorporation
  • Development activities related to a planned $22.4 million sanctuary housing project

Donations do not guarantee the construction, completion, or timeline of any sanctuary project. No donation constitutes an investment or creates any ownership or financial interest in SMSH or its assets.

4. Fundraising Sweepstakes Disclaimer

SMSH may conduct charitable fundraising sweepstakes in compliance with Oregon law.

Key Disclosures:

  • No purchase or donation is necessary to enter or win
  • Donations are optional and do not increase the chances of winning
  • Sweepstakes are governed by published Official Sweepstakes Rules
  • Odds of winning depend on the number of eligible entries received
  • Void where prohibited by law

Participation in any sweepstakes constitutes acceptance of the applicable Official Sweepstakes Rules and these Legal Terms & Conditions.

5. Prize Awards & Winner Obligations

Grand Prize (Vehicle)

Where applicable, one (1) Grand Prize winner may be awarded one (1) vehicle, subject to:

  • Verification of eligibility
  • Execution of a Vehicle Winner Agreement
  • Agreement to display SMSH’s QR code on the vehicle for a minimum of one (1) year
  • Monthly, in-person QR code compliance verification by SMSH staff

Failure to comply with prize conditions may result in forfeiture and selection of an alternate winner.

Secondary Prizes (Insurance)

Secondary prize winners may be awarded one (1) year of car insurance, subject to:

  • Execution of an Insurance Winner Agreement
  • Agreement to display SMSH’s QR code for the duration of coverage
  • Monthly, in-person verification by SMSH staff

All prizes are awarded “as is.” Winners are responsible for all applicable taxes, registration, insurance, and costs not expressly covered.

6. Winner Agreements (Binding)

As a condition of prize acceptance, winners must execute the applicable Winner Agreement, which is incorporated herein by reference and is legally binding.

Winner Agreements include, but are not limited to:

  • QR code display obligations
  • Monthly compliance verification
  • Forfeiture provisions
  • Liability releases
  • Publicity consent

Failure to sign or comply with a Winner Agreement constitutes forfeiture of the prize.

7. Publicity & Marketing Consent

By participating in SMSH sweepstakes or accepting a prize, participants and winners grant SMSH permission to use their name, likeness, city of residence, photographs, testimonials, and prize-related content for promotional, fundraising, and awareness purposes, without additional compensation, unless prohibited by law.

8. Limitation of Liability

To the fullest extent permitted by Oregon law, SMSH shall not be liable for:

  • Any indirect, incidental, or consequential damages
  • Technical failures, lost entries, or delayed communications
  • Injury, loss, or damage arising from participation in a sweepstakes or use of a prize

Participants and winners assume all risks associated with participation and prize use.

9. Indemnification

You agree to indemnify and hold harmless Sacred Mothers Sanctuary Homes, its directors, officers, employees, volunteers, and agents from any claims, liabilities, damages, or expenses arising from your participation in SMSH activities or breach of these Terms & Conditions.

10. Privacy

SMSH respects participant privacy. Personal information collected in connection with donations, events, or sweepstakes is used solely for organizational, administrative, and legal compliance purposes and will not be sold or misused.

11. Modification & Termination

SMSH reserves the right to modify, suspend, or terminate any fundraising activity, sweepstakes, or these Legal Terms & Conditions at any time, subject to applicable law.

12. Governing Law & Venue

These Legal Terms & Conditions, all sweepstakes, and any disputes arising therefrom shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to conflict of law principles. Venue shall lie exclusively in the courts of Oregon.

13. Severability

If any provision of these Legal Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

ADDITIONAL SECTION – TAX DISCLOSURE

15. Tax Disclosure

Sacred Mothers Sanctuary Homes (“SMSH”) does not provide tax, legal, or financial advice. Donors and participants are encouraged to consult their own tax advisors regarding the deductibility of donations or the tax consequences of sweepstakes participation and prize acceptance.

Donation Tax Treatment

Donations made to SMSH may be tax-deductible to the extent permitted by law, depending on the donor’s individual tax situation and SMSH’s current tax-exempt status.

  • Donors will receive acknowledgment of contributions where required by law.
  • No goods or services are provided in exchange for donations unless explicitly stated in writing.
  • SMSH makes no guarantee that any contribution is fully or partially deductible.

Sweepstakes & Prize Tax Treatment

All sweepstakes prizes awarded by SMSH may be considered taxable income under federal, state, and local law.

  • Winners are solely responsible for all applicable taxes, including but not limited to federal, state, and local income taxes.
  • SMSH may issue an IRS Form 1099-MISC or other required tax documentation for prizes awarded, based on the fair market value of the prize and applicable reporting thresholds.
  • Acceptance of a prize constitutes agreement to provide necessary information (including Social Security Number or Taxpayer Identification Number) for tax reporting purposes.

SMSH shall not be responsible for any tax liability, penalties, or consequences arising from prize acceptance or use.
